1. By entering this prize draw, an entrant will be deemed to accept these promotional terms and the Promoter's Privacy and Cookies Policy (which can be accessed at https://puppet.com/legal/privacy) and agrees that the decision of the Promoter is final and binding in all matters relating to the prize draw.
     
  2. PROMOTION PERIOD. The opening date for this prize draw is 12:00am PST (08:00 GMT) on 17 January 2017 and the closing date for entry is 10 February 2017 at 11:59pm PST (11 February 2017 at 7:59 GMT) ("Prize Draw Period"). The Promoter will not consider entries received after the end of the Prize Draw Period. 
     
  3. ELIGIBILITY. This prize draw is open to anyone aged 18 years or over resident in (i) the UK and (ii) the United States or its territories and possessions only, who completes and submits the online DevOps survey at https://devops-survey.com/register.php?uuid=4dbd9f88-49a3-5954-9681-6dcd21bf205f  ("DevOps Survey"), but excludes:
    1. employees of the Promoter and their families (and persons residing at the same residential address as such persons); and
    2. the Promoter's service providers, agents and anyone professionally associated with this prize draw.
       
  4. Only one entry per person. Therefore only the first completed DevOps Survey submitted from an entrant into this prize draw will be counted. If an entrant submits a DevOps Survey which, in the sole discretion of the Promoter, contains any response to a question/field which is incomplete, garbled and/or unintelligible for any reason then it will not be accepted in this prize draw.
     
  5. HOW TO ENTER THE PRIZE DRAW. To enter, please complete and submit the DevOps Survey available at https://devops-survey.com/register.php?uuid=4dbd9f88-49a3-5954-9681-6dcd21bf205f during the Prize Draw Period.
     
  6. Please note that the Promoter cannot and will not accept DevOps Surveys that are incomplete and/or where the entrant has not ticked the box in the DevOps Survey to show that he/she accepts these promotional terms and the Promoter's Privacy and Cookies Policy.  No purchase is necessary to enter. An entrant must provide the following information in his/her submitted DevOps Survey:
    1. his/her first and last name and email address; and
    2. a full response to each of the questions/ fields set out in the DevOps Survey.
       
  7. An entrant's responses in his/her submitted DevOps Survey will not affect his/her chances of being one of the winners in this prize draw.
     
  8. All entry instructions will form part of these promotional terms.
     
  9. DRAWING OF WINNERS AND NOTIFICATION. On 15 February 2017, 6 winners will be drawn using a computer process that produces verifiably random results. Each winner of a prize will be drawn as set out below. This is an independent prize draw which has not been authorized, sponsored or otherwise approved by Apple Inc., Visa International Service Association and/or Koninklijke Philips N.V.:
    1. The first person to be drawn will win one DORA Team Assessment – see section 10 for full details;
    2. The second person to be drawn will win one DevOps Enterprise Summit Ticket – see section 10 for full details;
    3. The third person to be drawn will receive one iPad Pro® – see section 10 for full details; iPad Pro is a trademark of Apple Inc.
    4. The fourth and fifth person to be drawn will each win one five hundred dollars US$500 (equivalent to around GBP£412) Visa® Gift Card – see section 10 for full details; Visa is a trademark of Visa International Service Association.

  10. Each of these winners will be notified by email on the same date sent to the email address he/she entered into his/her DevOps Survey (such email will include details of the specific prize he/she has been allocated in accordance with section 8). If a winner: (i) does not respond to such email within thirty days; (ii) refuses to accept the prize; (iii) cannot receive the prize notification email sent to the email address he/she submitted on his/her DevOps Survey; and/or (iv) refuses or is unable to prove his/her eligibility to enter the prize draw as set out in section 2, such winner forfeits all rights to receive the relevant prize, and another winner of that prize will be drawn and notified in accordance with sections 8 and 9. 
     
  11. PRIZE DESCRIPTION. See below information about each of the prizes awarded in accordance with section 8:

      Each winner is solely responsible for any costs associated with the prize or its use, including without limitation the cost of travel to and from the relevant event venue and overnight accommodation.

      We will not provide any form of insurance, including without limitation any public liability or cancellation insurance, in respect of such a prize.
       
  12. Each of the prizes will be allocated in accordance with sections 8 and 9. No winner will be able to change his/her allocated prize for another prize in the list above.
     
  13. There is no cash alternative in whole or in part to any of the prizes. Each of the prizes is non-negotiable and non-transferable. The Promoter reserves the right to award an alternative prize of equal or greater value.
     
  14. LICENCE AND INTELLECTUAL PROPERTY. An entrant warrants that the material in his/her completed DevOps Survey response is all his/her own original work and that it will not infringe on the intellectual property rights or other rights of any person. Upon participation in this prize draw, an entrant grants the Promoter and its affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sub-licensable right and licence to use, reproduce, translate and display the responses in his/her submitted DevOps Survey (in whole or in part) in the Promoter's publications and on its websites.
     
  15. THE PROMOTER'S LIABILITY. Except that the Promoter does not exclude or limit its liability for personal injury or death caused by its negligence or for fraudulent misrepresentation or any other liability that may not, by law, be limited or excluded, the Promoter accepts no liability in relation to an entrant's participation (or inability to participate) in this prize draw, including without limitation any use made by a winner of (or inability to use) a prize, to the maximum extent permitted by law.
     
  16. If the prize draw cannot be executed as planned due to technical problems or circumstances beyond the Promoter's control, the Promoter will not incur any liability and no payment or prize of any kind for the prize draw will be awarded.
     
  17. The Promoter's determination and decision on all matters will be final and no correspondence will be entered into. Any dispute or situation not covered by these promotional terms will be resolved by the Promoter's management in a manner it deems to be the fairest to all concerned and, subject to the following section, that decision will be binding on all entrants.
     
  18. APPLICABLE LAWS AND JURISDICTION.
    For participants who are in the UK, this prize draw and these promotional terms will be governed by English law, and an entrant agrees that any dispute between him/her and the Promoter regarding them or the prize draw will only be dealt with by the English courts, provided that, if an entrant lives in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there.
    For participants who are in the US, this sweepstakes and these promotional terms will be governed by Oregon law, and an entrant agrees that any dispute between him/her and the Promoter regarding them or the sweepstakes will only be dealt with by the state and federal courts located in Multnomah County, Oregon.
     
  19. If any part of these promotional terms is found to be unenforceable as a matter of law, allother parts of these promotional terms will be unaffected and will remain in force.
     
  20. DATA PROTECTION. By entering the prize draw, an entrant agrees to the personal information in his/her DevOps Survey being processed by the Promoter in accordance with the Promoter's Privacy and Cookies Policy (which can be accessed at https://puppet.com/legal/privacy).
